Terms and Condition Definitions

Customer
This is you, the person hiring the goods for trade or personal use.
Our, We, Donegal Tool Hire
This is us, the goods supplier.
Contract
Refers to the contract, verbal or physical, for the hire of equipment.
Hire Term
This is the period of time the goods are to be on hire.
Equipment or Goods
Refers to the items being hired by you, the customer.
Deposit
This is the payment in advance that may be requested by Donegal Tool Hire before goods are released.
Act of God
This describes unreasonable events beyond our control, such as natural disasters, pandemics and labour strikes.

Contract and Rental Details

What is a contract?

It is a legal bind between the provider and customer detailing goods, terms and conditions and expectations when both parties agree. This can be created in store, on the phone or by email. It serves as protection for both parties.

Equipment Hire

This is the items, tools and/or plant we hire to you, the customer. All equipment can be supplied with the relative health and safety paperwork, for example PAT tested, GA1 or CoC, upon request from the customer.

Hire Term

This is an agreed time frame for the use of the goods. We understand that this cannot always be absolutely accurate and can accommodate extended hire periods if we are given notice.

Minimum Hire

Minimum hire is 24 hours. Early return does not reduce the cost; however, late return may result in late fees, at one standard day's hire at a minimum.

Off Hire and Returning of Goods

All goods must be off-hired by phone or email during working hours, even if pre-arranged. Goods must be handed over to our staff, not left outside the premises. For collection, keys or remote controls, for example, must be left in a safe location. If these are lost or misplaced, the goods will remain on hire until these items are returned or replaced.

Hire and Delivery Costs

Costs and rates are always predetermined and will be set before the contract is made. All prices exclude VAT at 23% unless otherwise stated. Delivery costs can fluctuate, but we will always be as fair as we can be.

Payment

Payment must be made within 30 days of the invoice being submitted. Failure to do so can result in late fees and added interest. Failure to contact or receive contact from us regarding overdue payments can ultimately result in legal challenge. These are standard terms; feel free to contact us for specialised terms.

Additional Charges

Damage through accidental or misuse to hire items is chargeable to the customer. Cleaning charges may also apply.

Disputes

Any disputes or issues need to be addressed within 10 working days of invoice submission. We will address this and come back to you as early as we can.

Risk and Responsibility

This section explains the requirements and exceptions set out by us.

Responsibility is transferred to the customer once the contract has been agreed upon. This includes:

  • Basic checks and maintenance before use.
  • Using the equipment in a safe manner and for its intended use, as set out by the manufacturer's guidelines.
  • Ensuring that a competent and able person is operating the equipment.
  • Ensuring no damage, changes or alterations occur to the equipment. This includes removal of stickers or branding.
  • No loaning or sub-hiring of the equipment.
  • Keeping the machinery safe and secure and in the County, unless otherwise discussed with us.

Should any issues arise with the equipment, you must notify us as soon as possible and cease use of the machinery until told otherwise by us. Failure to do so may result in further damage and additional fees. If a workplace accident or injury occurs involving the equipment, we must be notified as soon as possible.

Damage and Loss

While on hire, you are responsible for any damage caused to or by the equipment being used inappropriately. You are responsible for any loss of earnings or schedule delays in the same case.

If the equipment is lost or stolen, you bear the responsibility. The hire term does not end until the equipment is returned to us, replaced or paid for. In a case like this, we recommend talking to us to work out a fair deal for both parties.

Transportation

Transportation is an option and is calculated by the current fuel prices, distance and size of the load. Our delivery fleet is extremely well maintained and on that basis we expect delivery sites and addresses to accommodate this as much as possible. Sites must be safe for our staff and equipment.

  • We do not offer an assembly service.
  • We can show customers the basics of how to use the machine upon delivery; however, this is not an official training course.
  • Equipment must be checked upon delivery by the customer.

Collection

Collection is also an option for the customer and we will help to load. We can also load heavier items with equipment we have in store.

Breakdowns and Machinery Failure

This is seldom an issue, but on occasions it happens. We aim to:

  1. Solve the issue over the phone.
  2. Send a technician as soon as possible if required.
  3. Replace the equipment with an alternative as soon as possible.
  4. Allow additional hire time to cover the downtime.

If the breakdown is a result of misuse or abuse by you, this may result in additional fees.

Contract Completion

When the hire equipment is finished with, it must be off-hired by phone call only. Please ensure the goods are:

  • Reasonably clean.
  • Easy to obtain and unobstructed.
  • Disassembled if applicable.

If the goods are in a different location, this must be made known in advance of the collection.

If returning the equipment yourself

  • Return the equipment during working hours only.
  • Make us aware you have taken the goods back.
  • Ensure you are returning all parts of the equipment.

Phoning and off-hiring equipment you are to bring back does not off-hire it. It will remain on hire until we physically receive it.
